Tires that are in the shop should have a manufactured date or code on them. I wouldn't know how to read it, but almost all commercial products have a code or date stamped right on them. Probably go to the manufacturers website to find out.
Tires shouldn't get 'hard' before 3-4 years of use. After that roughly defined timeframe, depending on the quality, you might think about replacing regardless of tread depth. I would definitely replace any tires older than 6 years.
I would say if you go to a shop that does a lot of business, and don't buy an oddball tire, your chances of getting a tire that is 'hard' or past it's recommended use-by date is pretty slim.
