I am confused about the confusion. It is an open market. If they are able to set their price they always try to go for what the market will support that generates the most profit. What is gouging anyway and so what? Some regulations term certain pricing practices "gouging" for certain circumstances and regulate it but that really is the exception. Here, in my state, when it comes to gas there is no state limit to how high they can set the price. The only legal requirements here are that they can only raise their price once every 24 hours, and the price can't be higher than their lowest advertised price, and it can't change while a person is fueling.
