who wish to downsize as economically as possible to make unreasonable goals for a group and then fire them for not making it. The employees are fired for poor job perormance, which on the face of it, would make it seem to be a situation where they wouldn't be eligible for unemployment. However, I have heard of many instances where people do file and win on the appeal. Of course the company denies the claim because the person was let go due to "poor job performance", however during the appeal hearing, he/she is given the benefits because the arbitrator sees through the companies ruse.
However, whether or not this person wins unemployment benefits, I would recomment contacting a good labor attorney and discuss filing a suit for wrongful termination.
