Unfortunately what you need may not be legal advice. All the lawyers in the world can't turn a bad mechanic into a good one!
You've obviously had pretty bad luck with this transmission issue, and the tough part is finding who's to blame.
Whenever you install a used part, especially something as complicated as a transmission, you're taking a risk. I've gotten transmissions from junkyards and when I drained the fluid from them, it was 2/3 water!
On the other hand, if there are issues with the transmission mounting bolts (which you have correctly surmised are important!), it's tough to blame that on the used tranny - responsibility obviously lies with whoever installed it. First thing I'd do is carefully check *all* the bolts. Every bolt that is present, check with a wrench to make sure it's good and tight. Holes that look like they should have a bolt, either look behind them to see if there's something to thread into, or if you can unscrew one bolt, try it in the other holes. If more than 1 bolt is loose, or bolts are missing, I'd consider that a pretty serious black mark against that mechanic. If it turns out to only be one bolt, that's still not good, but I might be more inclined to consider it a one-time oversight.
In any event, the best course of action might be to see if you can get the car drivable yourself - tighten loose bolts and replace missing ones, get some fluid in the trans, then get the car to a different mechanic for a careful assessment.
