I think the "do gooder" in your newspaper story is probably correct.

As others have written, there are FAA approved IFR approaches of various types to many airports, and there are specific tolerances of vertical and horizontal space that we pilots must adhere to. Build a building within those tolerances and you might kill me or any other pilot flying that approach.

The statement that the "FAA has notified pilots" sounds incredibly misleading, as it likely refers to a NOTAM (Notice to Airmen) that is published for the purposes of, among other things, warning pilots of obstructions in the vicinity of an airport. This is not even REMOTELY the same as approving such a permanent structure as a building and such a NOTAM is typically used to inform us of a temporary condition such as an unlit radio tower undergoing maintenance or construction (hence the lack of tower lights) or a construction crane in the area, etc.

I agree wholeheartedly that if the developer built this building and it (allegedly) is infringing on a published FAA IFR approach, not only should they demo the building but they should be put in jail in my personal opinion. Even been on an airline flight descending to weather minimums, when you know you're close to the ground and if feels oh so darned good when you break out of the clouds and you see the airport environment? Imagine instead that you are expecting to see that airport and instead you slam into a building!!!

You cannot construct any fixed obstacle (tower, building, etc.) that is over X feet high Y feet distance from the centerline of a runway without it being considered an FAA "major action" and therefore requiring FAA approval.
