I do not know the answer to your specific question (ie: when?), however, in many jurisdictions the code is enforced differently. Here, in New Orleans, if 50+% of the building's electrical system is affected by a renovation or addition, then the entire electric system must be brought up to code. If not, pre-existing "flying taps" do not have to be boxed. Naturally, any new junction or splice would have to be inside a junction box and that box would have to be accessible after all work is completed. Therefore, a box could not be concealed inside a wall; it would need a visible cover plate.
Of course, the ultimate decision is made by the on-site inspector or his superior in the permit office.
