It goes both ways of course. Some people are overpaid for the vehicle others underpaid.
ALso, keep in mind your still getting potentially financially messed over in some cases either way if you have a good car that you have maintained well and plan to have for many years. This can be especially true for someone who doesn't drive many miles and keeps a car in very good condition and plans to own it for an extended period. The economics are based on getting many years of service from it in this case. When this is cut short by a crash they are financially messed over.
If it is their fault then tough luck they have no reason to complain. Insurance only should cover the market value of the car. However, in the case where it is not their fault the law requires that they be "made whole". By insuring the other driver, who is at fault, it becomes the insurance companies legal responsibility. Remember they are not buying a car at market value (let along taking a trade) they are making the victim "whole" for a loss created by negligence. Problem is this is often very hard to determine. They want to handle it like any other loss. However, if negligence is clear cut that isn't good enough. One thing that is always clear cut to ask for is sales tax on the value they give you for the car. They won't offer it but they won't protest it either.
Now for someone that is driving their car into the ground and not doing maintenance that hasn't yet been recouped the deal might be rather favorable. But for some it really misses the mark.
