Way OT: Septic Tank, title V and legal issue?

Any help would be much appreciated. We bought a house last November in MA. The house has a septic tank. The Title V report indicated the tank was OK. The real estate agent told us the tank had been emptied as part of the Title V inspection. In fact, we have a voicemail saved from her where she confirms that. We called the company who did the inspection and they said the tank had not been emptied as part of the inspection.
Long story short- since the tank wasn't emptied, we go ahead and have a company come out yesterday and empty the tank. They look inside and say the tank may have shifted. They said they weren't sure how the inspector could have actually inspected the septic without the tank being empty, considering the fact the contents of the tank concealed the possible shifting of the tank wall. Tank doesn't appear to be failing, but it's a risk.
Any thoughts on legal actions we should take? The real estate agent told us the tank had been emptied- it hadn't been, and the Title V inspector missed a potentially major issue.
Help is much appreciated!
