The guy who emptied the tank is right - I don't know how it could be inspected without emptying it. It would have been reasonable for the Realtor to assume that the tank had been emptied, since it had a valid Title V. Of course, she still made a misrepresentation when she stated that it had been emptied, while in fact it had not. My guess is the guy who issued the Title V for the previous owner was a shady operator. Maybe the seller was a shady operator too. A valid certificate was obviously issued without a proper inspection being done. While MA requires a valid Title V for the sale of a house with a septic system, I don't know what the legal comeback is on the seller or the inspector who issued a certificate without a proper inspection. Does anyone know if Title V inspectors carry professional liability. Like ozzie said, a lawyer is a good place to start. Somebody should end up in deep sh*t over this. Ahhh ahhhh ahhhh....
