hi, i am yaofeng's son, the victim in the accident.
to hopefully clarify everything, i was not hurt in the accident, except a cut less severe than a papercut; it went away the next day.
according to the police report, the other driver did not receive any charges of any wrongdoing.
the reason we have an issue with it is i was in the right lane the entire time, and the truck in the left. the officer claimed i changed lanes at the same time as the truck driver, causing him to sideswipe me.
which i deny, because i was maintaining my lane and already next to the truck when he began to change into my lane.
as my father said, we have damage to the rear quarter panel, which hopefully should prove that i was already next to the truck when he decided to change lanes.
now the other party's insurance agent already arrived with the checks which we still have, untouched.
from my limited knowledge of the law, i believe our issue now is with the police department that issued the ticket. i have to contest the ticket because the police report is incorrect. if a judge reverses it and gives the other party a ticket, that is not our business.
i think that our acceptance of the checks from the other party's insurance company is only an agreement that we will not take them to court, directly (which i have no intention of doing). it has no guarantee that the police department will.
correct me if i'm mistaken.
