Ok Long story short:
I have an idiot younger brother who lives in GA and had a restraining order filed against him last year by his childs mother. In the last two months the mother has contacted him numerous times and against what everyone told him, he agreed to meet her.
Come to find out his ex filed the restraining order because his ex's mother threatened to take the baby from her.
In the meantime the ex's mother found out about them meeting on a few occasions in the last two months and had him arrested for violation of the order. Today he was sentenced to four months (remaining time on the order) for violating the order.
Does he have any recourse against her? I mean how can she file an order against him and then contact him with impunity? The judge got to see all the text messages she had sent him asking him to call, asking him to meet her. Even the "adult" picture messages. But still he is sitting in jail because she cant stand up to her mother and have the order dismissed.
I agree the law is the law and he violated the order and he is getting what he had coming to him by seeing her but isnt there any recourse for him because she essentially enticed him? Maybe even entrapped him?
