What recourse do I have? Anything? Posted by rpm2 [Email] (#259) [Profile/Gallery] (more from rpm2) on Sun, 29 Nov 2009 07:17:55 Members do not see ads below this line. - Help Keep This Site Online - Signup |
So I bought this 2006 9-5 AERO a month ago and for the most part I think I have a good car.
One thing is just driving me nuts. I realize it's sold as AS-IS but- here's my story.
When we bought this car from a private seller I asked for an inspection which I paid for. The car was in another state. So I let the seller arrange for the inspection at a local SAAB dealer. Well a long story short, I got this partial fax called an inspection report missing a key problem which unfortunately we couldn't detect on our test drive. They wrote this problem on the work order which I never knew about.
So we go to this other dealer on the way home after picking up the car for an oil change and realize there is a balancing issue. The dealer told us we had 3 bent rims at 300+ a piece.
So here's my complaint. There was this disclosure issue between the seller and me over the inspection report which I never knew about until later. He was the owner and I wasn't. I thought I worked it out over the phone with the seller and he said he had no issue faxing me the report. The dealer faxed the report to me and everything looked fine.
When I called the dealer afterwords (after I knew about the rims) they said they told the seller about the bent rims. The seller denies this fact. I've seen the rims now and based on the dealer who did the inspection could account for the problem perfectly. They knew the 2 in the right were the most bent. So I believe the dealer did find the issue and the seller knew about it too. Why would the dealer hide this issue.
So I have been calling the seller and he seemed legitimate at first. He even offered to pay for one rim and felt bad about my problem. He said he wasn't aware of the bent rims because he only drove the car in the city. He denies the work order had this documented information. I said to him -if that's the case, mail me a copy of the work order. That being said he always tells me he is going to pay and mail the work order and never does. He always says – I'll get it in the mail tomorrow.
Since then I've also found a rim repair shop in the same area of this dealer ( 1 ½ hour drive) with the equipment to straighten out and refinish rims. We are getting them back next week.
So what would you do? Of course in retrospect I should have arranged for the inspection myself which may be the only lesson learned.
