Agreed with retaining a lawyer... just make sure you do your due diligence on the one you choose... nothing is more expensive than bad legal advice or representation.
Having a lawyer will also tell the insurance company you are serious and they may decide to settle.
Plus if you don't have one, especially one that specializes in this type of stuff, the insurance company may use legal maneuvering to either kill the case out right or effectively get it killed (i.e. lots of stalling maneuvers).
There is also the possibility any judge won't take you seriously if you are representing yourself, especially if the judge and court has a very full case load, and if you do find a sympathetic or patient judge, the Insurance lawyers may try to get the case re-assigned, either directly or indirectly (stall long enough for that judge to become overly full and then get it moved).
In case you are getting the impression this is one big racket to keep lawyers employed... you are essentially correct. It is the worse possible legal system, except for most if not all the others.
