Anyone with experience re: Non-compete Agreements?
Short version is subcontractor company was fired, contract with defense company was cancelled/terminated legally by customer, employees were let go with a "Lack of Work" termination letter Nov 30th, and have been offered jobs in the same field by another aerospace/defense company.
President of fired subcontractor company refuses to release employees to a similar field employer.
Subcontractor company HQ is in Ohio, the employees are in Georgia where the customer was. Subcontractor company has no other job openings in Georgia, or elsewhere.
My understanding is that the old employer would have to go to Federal court in order to have the Ohio agreement applied in Georgia. Any thoughts?
