My experience in MA is similar to what everybody else has said. After the entire staff of a company I worked for was presented with a 'sign it or else' non-compete agreement, a group of us got legal advice on the matter. The most significant piece of information was that once employment is terminated by the employer, non-competes are immediately invalidated. This appears to be the case with the folks you mention, but they should obviously seek legal advice locally, which will likely confirm this. There may be some weird nuances specific to an industry as specialized as defense. There will likely be a lot of people exiting the defense industry in the coming months, who will, in time, figure out a new industry/industries where their skills are useful and in demand. As an aside, the lawyer told us that in cases where non-compete agreements end up in court, the court almost always sides with the employees, unless there is a case where an employee or group of employees left a company in a premeditated fashion and took work/client(s) with them.
