There is a very good reason for the prior notice requirement. Government cannot be held liable for damages caused by conditions unknown to it. If the condition becomes known, the law provides the government a reasonable opportunity to eliminate it, or face liability for failing to do so.
So, if this happens to you, file a FOIA request on the governmental agency responsible for maintaining that particular road, and make inquiry as to whether anyone notified them of the hazardous condition. If they had notice, file your claim - but depending on the state, you need to file it within 60 or 90 days of the incident.
