Two things to consider:

- state law.
- your negotiating skills

Start with the state law. Most states are now Actual Cash Value, which translates to what you could sell your car for, not what you could buy one for. That gets the insurance company out of the discussion that dealers would charge more for your car vs. a private sale. Also read you insurance contract, I'm sure there are still states where the company has more flexibility about what they sell you, whether you know it or not.

Next is negotiating. I find that being reasonable when you ask for more is the key. If the company likes to low ball people, then the person at the other end has Maalox filed days of irate phone calls. Do your homework, find out the real value, tell them and offer to compromise at a reasonable number.
