As ELaw said, it depends where you live if your looking for the "legal" limit. Here in Florida I regularly see backing plates of pads ground deep into the face of rotors since we have no state visual or emissions testing (did for a couple years back in the 70s). You should see some of the "vehicles" on the roads down here, scary stuff.
If you live in a state which requires inspection, usually the pad thickness is measured with a pad depth gauge (in 32nds of inch similar to tire wear). The specific thickness depends on the state regulations but I believe that 2/32nds is pretty standard which is also the depth of the wear bars on tires.
