There are definitely cases of engines consistently over-delivering on the dyno going back to the '60s. A famous example is the Japanese gentlemen's agreement to not rate anything over 276hp for many years.
276. There's certainly been cases of under delivering too and subsequent lawsuits. I think Mazda went through that a few years ago.
As for 350nm, why not I guess? With turbo engine you can easily dial the software tune to get an even number. I feel on NA motors you more get what you get - no one would redesign a cam profile to hit an even number.
