John: I will not give you advice like that of the lawyer,PIDGEON, who has suggested as an officer of the court that you bribe somebody, but even though I do carry a detector, I suggest that your wife's only possible defence would be to have the officer present his evidence that the reading he got HAD to be from your wife's car, and could not have possibly come from another vehicle. Considereing that he said she was only going 2 MPH faster than surrounding traffic,she just might put a bit of doubt in the nind of the jusge, and get it thrown out.
I cannot believe that a lawyer would use the lame argument that he just talks to someone who knows someone etc.etc.
Depending on how the paw is written in your county,you might also ask the officer where the radar was positioned in relation to your wife's vehicle's line of travel. In radar, there is a formula called the cosine factor which says that the speed that the device reads is the true speed times the cosine of the angle formed between the vehicle's direction and the line of the radar beam. Since the cosine of an angle less than 90 degrees is less than one, this means that if there is a significant angle in the reading, the radar would actually read a speed lower than your wife's true speed. Sounds bad? Not really. In many jurisdictions, the officer must not prove that you were speeding, but must prove how fast you were going. If you can show that his reading is in error, you might win. I did this about twenty years ago in NH, and won( of course the judge also told me it would not work a second time, but that's to be expected). It was for 62 in a 45 zone. Make sure you have all of the info on what type of radar he had, and very specifically, his location. If he is unsure of his location when he took the reading,you will be golden! planting any legitimate doubt in the judges mind could be enough to turn the trick.
