Hello everyone. It has been a while since I've posted here because I no longer have my Saab :-( I recently started leasing an Audi A4 1.8T with quattro. I would've gotten a Saab, but I wanted AWD. But that is neither here nor there right now. I was at Target (a well known all-purpose chain of stores) in the parking lot yesterday. I decided to live-park right in front of the entrance while my girlfriend ran in to get a couple of items. While sitting there, I was watching an older guy collecting shopping carts (can anyone see where this is going?). I don't know exactly what happened next, but the next time I looked up, I noticed a shopping cart rolling towards my car from the entrance and the cart-guy within about 10 feet of this happening. I don't think the guy pushed it at me or anything, but he certainly didn't grab the cart. It was slow-motion...I couldn't do anything! I watched the cart fall off the curb and slam into my front right fender. There is a very small, but noticable ding in the fender now. It's a leased car and I want to keep the paint from chipping and the fender rusting as a result - I need to get it fixed. I'm wondering if I can hold Target responsible for it? Can I claim employee negligence - the guy not grabbing the cart 10 feet away from him while it's careening toward a car - or any liability on the part of the store??? I talked to the 18 year old manager on duty and he took my name and number and registration, etc. He told me that he'd have to forward the info on to the owners of the parking lot because it isn't technically their property - but it was their sidewalk it fell off of, and their cart, and their employee. I was just wondering if anyone out there is a lawyer and could offer any (free) advice on the situation... Thanks in advance...and I'm sorry I don't own a Saab anymore, please don't hold that against me ;-)
by the way, I got an estimate for $180 from my favorite body shop.
