I don't know any details about the VW engine failure, but the 9-5 has its share of issues. I'd bet more than 39 failures due to sludge. And I know more than 39 people have dealt with the rear suspension issue in one form or another. One could argue the suspension issue is wore because there doesn’t seem to be any definitive fix unlike the sludge and I guess the VW engine issue.

I'd consider the load rating on both if you plan to load up the wagon. I'd actually test load both wagons for usability and to see how they drive loaded. Carefully examine both for ride height and camber issues (unless this is a nonissue on the VW suspension setup). I'd also carefully assess the dealers if you'll be working with them on warranty issues and your past experiences with each brand.
