I think that depends on the situation. That is probably what I would have done to unload the idiot Cruze driver if there was space to pull into the middle lane by slowing down (or do the slow down speed up thing to make space in a really boxed in situation)... But, sometimes it's a case of you were passing a string of cars that were following a slow driver causing the congestion. Some guy comes up hard from behind because you are not going as fast as them. What they are doing is far more dangerous and should be penalized, but of course life's not fair... I have certainly accelerated a bit more in that situation to get into the space and get the guy off my butt... not unreasonable imho if the speed required isn't excessive and slowing doesn't match you with a safe gap...

an example I had was I was in the left lane waiting to pass 2 trucks that were passing each other... at 45 up a hill in a 65 zone. a-hole van comes up behind me *fast* (like 80+, could see him in the rear view just as I started passing the trucks). I hit the gas harder (in the 9-5 so it was up in the 75-80 range instantaneously - I can see how one can get a ticket in an Aero!) and was past the trucks and into the right lane with him on my bumper only momentarily before I slowed back to maybe 10% over the limit. If I had tried to slow back down to <45 to fall back behind the truck I was already passing, I would have risked a collision...

I guess the moral question might be: if there was a gap near ahead and one was passing each car with the <2 second rule, then you'd be past in 2 seconds anyway, no big deal, pull into the gap (like my example)... If the limit was 65 and the traffic to be passed was near the limit, you should get by them fine at 75... if the traffic was going 75 already in a 65 zone so you had to pass at 82 to get by in <2sec... well, 75 was speeding already, so yeah, pretty hard to argue you weren't speeding - could have kept in the flow... but I don't think he's suggesting that he wasn't speeding or not admitting some level of guilt in that regard...
