if I crash while skiing and my bindings release correctly, but I bounce into the woods and am grievously injured from hitting a tree, I can sue the binding mfgr for making bindings that worked too well.
If I slip on a rock in a stream while flyfishing, hit my head on a boulder and am paralyzed, I can sue makers of all the equipment I use because they made it possible for me to on the stream in the first place. Not to mention the car maker that made it possible for me to get down a bad road to get to that spot. And the magazine that told me about the spot, the place I bought lunch....
And if I go to sleep and fall out of bed, whack my head on the night stand and go blind in one eye, I can sue the mattress company for making a bed that was too comfortable, the flooring company for not using wood that will absorb my fall, and the table mfgr for having hard edges on their table.
There is no conceivable reason why any court should allow that kind of award. The judge must be asleep or on the take. And the lawyer (sorry crystobal) should be ashamed of himself. The dude went to sleep. He drove off the road, rolled and was badly hurt. His fault. Was he wearing a seat belt? If not he should have no coverage at all.
This is not the end of this case. It would set too big a precedent. GM will ratchet up the legal work on this one.
