when a drunk totalled our '01 wagon, the first offer from the ins. company was 'way low, based on ONE other wagon with 40K MORE miles! Having been through this sort of thing before many years ago, I politely told them I DECLINED their offer. After the agent got all huffy and said she'd never HEARD of such a thing, I very politely mentioned that my lawyer would be more than happy to explain it all to her. Said she'd "do some more research" and get back to me. BTW, the drunk was also insured by our ins. company.
They eventually came back with what I thought was a reasonable offer, plus tax and registration fees, which we accepted. We were unable, in the winter, to find another comparable wagon, and ended up buying another used 9-5 wagon, (4 years newer) CPO, for about 7K more than the settlement.
NEVER accept the first offer from an insurance company! NEVER! The agents NEED to settle these cases especially where the other driver is 100% at fault. YOU are in the driver's seat, so to speak.
I dunno if it did any good, but I called my local broker/agent (not the rep handling the settlement) and told her that if we didn't get a decent outcome, I would cancel our auto, homeowners, and my business policies and find another insurance broker. FWIW, we had never had a claim except for using our towing insurance (another kind of ripoff, BTW...) in many, many years. I also mentioned the name of our local attorney's firm and suggested that perhaps it might be a tiny bit fradulent to sell policies that don't pay out properly when a valid claim is presented.
