1 - most insurance companies now cancel policies when a certain number of claims come in. You're better off collecting from them
2- your cliam is against them, not the insurance company anyway. they may lose the ability to have the accident covered if they don't report it.
3- they, and possibly you may be required to file an accident report, and if you do it and they haven't told their carrier, they are in violation of their policy terms.
4- where i live there is a small claims court procedure designed to be used by non-lawyers.
Write to them, certified as someone else suggested, and tell them you will shortly (give them # of days) have the damage repaired and then sue them for the $, and say that if they want to have their carrier look at the car, they'd better do it promptly. And say thyat if you are forced to do that you will report the accident to the state as well.
In the end, you may have to sue, so take pictures before you do the repair.
Or, if your broker tells you not to be concerned about cancellation, collect from your carrier and let them sue the other guy.
