They don't want to for the same reason you stated they should - there are sponsors who have sunk millions into a team and driver and losing them for a weekend hurts their fans, their business partners, any advertising/promotional programs in place, etc, etc. NASCAR levies fines to get their attention but everyone knows the fine is not going to bankrupt some driver or team. But NASCAR doesn't want to alienate sponsors so fines are the answer, albeit not the best one maybe.

But NASCAR does deduct points from the car owner and driver and that could make a serious difference in where they finish in the points standings. For example, two years ago Mark Martin was in a tight points race with Tony Stewart. NASCAR caught the #6 team using an unapproved part (springs) and docked the team 25 points (IIRC). Martin lost the championship by 38 points but who knows what would have happened had they not experienced that distraction.

I think the days of Cale and Bobby and Donny duking it out on Daytona's tri-oval grass are long gone. There are scuffles and pushing and shoving and the occassional punch, but no out-and-out brawls anymore. You'll always have minor "disagreements" between competitors. Racing is a very intense and highly emotional activity. Wins are hard to come by in NASCAR and spending millions guarantees nothing in the sport; not even a starting spot. This paradigm simply does not exist in other pro sports. The pressure to perform destroys people. If you compare NASCAR to other contact sports, brawling and fighting is pretty rare.
