Here's the scenario
I own a 3-family house. I had some tenants move in July 12 with a 6- month lease that expires on Dec. 12th. They paid me first, last, and security. First month was prorated so that the payments would be due on the first of each month for the remainder of the lease, except the last payment on Nov. 1st, which would be the reciprocal of the first month (i.e. pay for 12 days thru nov. 12 and the last month, nov.12-dec.12 is already paid). Anyways, my tenants didn't pay me in November. I took the money out of their security deposit. They told me then, that they were going to move out on Nov. 20th and wanted the balance back. I said, no way, I don't even have tenants yet, and you are obligated for the term of the lease. They finally backed down and moved out and had paid the balance. I finally found tenants, who I proceeded to move in on Dec. 1st. Yesterday, the prevoius tenants called me and demanded that since I had rerented the property, they wanted the balance sent back to them for the time between when the new tenants moved in and my old tenant's lease expires (in other words, approximately 12 days of rent). I said they effectively broke the lease and were not entitled to a refund. He said, i'm calling my lawyer...
I am not trying to be a prick to these guys, but this guy is a real bastard. He calls me screaming and yelling - its in the lease clear as day what his obligations are...
