In principal, I agree with you.
But the problem is the precedent that "best guess" law enforcement sets. While there is no argument that he was speeding and arguably driving recklessly, the bottom line is that if we allow the police or other enforcement agencies to prosecute based on WAG, we are effectively saying that not only can people be charged for crimes they didn't commit, but that sentences are not based on the crime, but based on the perception of the crime.
From what I've read, that bike is probably not capable of much more than 170mph, meaning the officer was probably exaggerating by 18%. I peronsally don't buy that "modified" argument at all. Getting ANY vehicle from 170mph to 205mph is no trivial undertaking - especially not for an already strung out bike. That same margin of error could cause a minor speeding ticket to become misdemeanor for you or I, or be the difference between theft and grand theft for a burglar.
I'm not endorsing crime or criminals or making excuses for lawbreakers, but our entire justice system is *supposed* to be based on accurate accounting and proof. If we throw those guidelines out the window - no matter how upset we are about a crime - we give law enforcement a LOT of power. Personally, I'm not comfortable with that *at all*.
So, yeah, this guy is gonna get off "easy." No one was actually hurt, no damage was done. And maybe Mr. Trooper will be more careful when noting details in the future. I'd certainly hope that if he nabbed me for my traditional 10-over, he won't let his indignation affect his writing skills.
