...I drive tops 9 miles over the limit. Given the standard error built into speedometers and radar guns and ladar guns, I can effectively fight any summons. My morning commute is 17.5 miles. If I hypothetically drive at 57MPH in a 50 zone, I get there in 21 minutes. If I drive 80MPH, I will only save 5 minutes. The summons does nto justify the speed. The only time I consider speeding is on interstates when I follow the flow of traffic. In those cases it can be argued effectively in court that not driving at the rate of 85 percent of traffic flow places me at risk of serious injury. Traffic departments keep a record of 85 percent traffic speeds, and they usually top 70MPH. To drive too slow in such a zone risks rear end collisions in excess of 15 MPH. In the process of discovery, the prosecuter needs to turn over the 85% information, as it is public knowledge.
