Car strikes pedestrians: Failure to replace dirty brake fluid during inspection: Wrongful death: Settlement.
The shop was found liable for inspecting the car and not letting them know the brake fluid was dirty.
This shop could not win in any case from such an aggressive lawyer going after insurance money.
As many of you might know. IF? the brake fluid is so dirty that it has compromised the brake system so that it is close to failure, flushing the system might very well bring it over the edge and the brake system fails shortly thereafter and the shop would be liable anyway.
IF? the shop had flushed the system and brakes were working fine, the lawyer would still have found a way to say that the shop did something wrong and they should be liable. He only needs to convince the jurors which is not difficult in CA.
BUT that CA State allows a blind person to drive, that is not a problem and they cannot be sued.
