I hear you and as always, we don't get the full legal report by reading a news article but the thing is, the discolored brake fluid is most likely not the culprit here but a nice scape goat to lay the blame on since it is money behind it.
We don't even know if they bothered to test the brakes on the car at a test station afterwards. That would be a simple test to see if the brake pedal goes to the floor over and over again or not.
If the brake fluid has been allowed to be in there for so long that it plays a role in how the brakes are working in a panic situation, it means that the brake master cylinder is shot. This is a work in progress that has taken years to reach this state of deterioration.
But the shops insurance company probably knew the futility to fight a jury in a sensitive case like this and just wanted it to go away.
