Looking at it another way, the car was inspected and the brake fluid -both sides agree - was not clear. This was a bad inspection. (Inspector originally said it was clear but this was changed when it was shown that it was unlikely to be true). So you have a failure to do what you hold yourself out to do. As a result a person is killed. So you have liabiliity and damages. Believe me that insurance companies don't give out 1 million dollars unless they think they are liable and are going to have pay more. The size of the payment neans that the insurance co know what caused the death and settled. That is why people have insurance. As to the State, they are generally imune from suits for neglience. Anyway, it would not be the State paying it would be the tax payers. However you look at it we pay through taxes or insurance premeiums. You can always say that even if they had done their job right the brakes might have failed for some other reason. They didn't do their job right. Keep paying your premiums. (No Disclaimer- I am NOT a personal injury lawyer and don't make any money off this sort of thing or any other kind of civil litigation).
