I built a two-story two-car garage (art studio up top) and "no rental apartment" was absolutely part of the building permit. I don't know what would happen if you built it out for your mother-in-law, and then rented it out after she left town - hmmmmmm........

Check your local zoning for similar restrictions. Do they have zoning in Houston?
