The law only mandates the same diagnostic capabilities as a dealer software - so I am sure the manufacturers will try to exclude firmware upload and configuring settings as not being related to "diagnostic". This does not help in case of VW/Audi or Saab as this capability is already there, thanks to aftermarket. But it will help in case of other brands. It will also prevent the future VAG from adding authentication chip to their readers (it is for your safety, sir).It will also be much cheaper due to a common interface - just look at $10 OBD2 readers today.
Decifering the codes will still require "fairly priced" access so it will not likely be cheap.
