There was a good line from drivers ed:
There's no such thing as "accidents", only "collisions"... although usually 1 driver is predominantly at fault, there is always something all drivers could have done to have avoided the collision... even if you are stopped and rear ended by someone not looking and talking on a cell phone.
We have this direct compensation system (aka "no fault") of insurance here where a % of fault is assigned (by the police I suppose) depending on the circumstances. Your insurance pays you (not the other guy's - there is no way to sue afaik), with a formula of the % not at fault coming from DC, and the % you are at fault coming from the collision chunk of your policy... your rates only rise based on the % of at fault... DC is mandatory collision is not... it probably saves court costs, but if a rusty old toyota rear ends a porche, the porche gets fixed out of DC, the toyota guy's rates go up, but the porche guy pays more annually in DC for driving a nice car... DC is the predominant factor in the cost difference to insure our 9-5 vs c900... kind of wrong imho (effectively a government induced multiple priced monopolist scheme for the insurers)... but them are the rules...
