it's not so much that one is "at fault" when being rear ended - the other driver is clearly 100% at fault... however, it is possible to avoid (or at least diminish the severity using defensive driving techniques)... if you stop immediately behind the car in front of you and stare blindly forward looking at the light (or drinking coffee, reading the paper, etc), of course there is nothing you can do... if you leave enough of a gap and watch the rearview, you can do something (if nothing else, mitigate the impact)... the point is one is still driving even when stopped...
one that surprised me: a buddy was parallel parked and buckling his kid into a car seat with the drivers side door open. an old lady drove by taking out his door and missing him by inches. he was 100% at fault under the rules here because he did not have an eye witness to prove he did not open the door into her path! that is the default judgement of fault in that situation!
