I won't claim to have firsthand experience, but over the years have had many coworkers who were foreign nationals and here temporarily or permanently.
Almost all of them at one time or another have mentioned needing a lawyer to deal with immigration issues... the impression I get is you can't get the time of day from the government without one.
I'd hope that rather than being a black hole, for a relatively small cost a good immigration lawyer could at least tell your future son-in-law the chances of success with what he's trying to do. And hopefully an approximate cost to do it.
But I agree with Les_H that he may be on a bit of shaky ground if he's already running a business on a tourist visa.
