The USA is a very litigious society and lawsuitscan take down a business - on the other hand, if there is an easy to implement safeguard that was eliminated and it could have prevented damage or deaths, then the manufacturer has some culpability - see story at the link. Often times, if damage occurred, the affected parties will try to collect from anyone with "deep pockets" if negligence can be shown. I am not a lawyer but did take a course in product liability issues, however I can't comment on this case without more detailed information.
On the other hand, the EU has its own product regulations that we find absurd, i.e. changing the front profile of cars to lower injury to pedestrians when struck.
