The wastegate absolutely *can* be open with the rod connected... if the rod is adjusted wrong!
Which is quite possible with a rebuilt turbo... they probably figure whoever installs it will adjust the wastegate.
What you need to do is move the rod back and forth and see if it feels like the WG valve is being pulled fully shut. Or just adjust the rod a few turns shorter and see what the effect on boost is.
