This would go no place. Not all issues or repairs are going to even show up on a car fax. They can't possibily be all knowing and make no such representation. Cars are repaired, fixed, and abused all the time and it wouldn't be reasonable to assume they would know about these events. It is also reasonable that there will be a delay between an event and reporting of an event. The car may well have been fixed and sold before the information even became available to carfax.
There is a reason they limit their "guarantee" to title branding as of a date. This is a matter of record. They are not all knowning and certainly not in real time.
Of couse another possibility is the information is ouright wrong. If there was frame damge one should be able to spot evidence of repair. Look at the car. Is there evidence of accident damage? Does the current condition match the reporting? If not then there may indeed be place for a claim.
