I considered at least seven different options before making a purchase. I didn't want to list them all here because it would read like a novel.
Small claims court on a 3 year old bike with damage history (show me a mountain biker who has never fallen and I'll show you one who's not trying hard enough) will lead to a loss and a lot of money spent on a lawyer. Might as well just flush it down the toilet. I have worked for manufacturers my entire career. Manufacturers don't simply admit guilt even for known defects. They re-design and hope for the best.
I didn't "give up." I chose the course of least resistance and immediate results and got myself a new bike which I just completed riding for the first time tonight.
