were driving? were you on a headset?

the officer would pull you over i'd think if the saw you with it slapped up to your head irregardless of whether you were actually on a call or not.

if he had pulled you over for some other offense (ie speeding) and your phone was sitting on the seat next to you, then you might have a chance.

are you aware of the fuss in the news about accidents and handheld cells while driving and the fact that many states have laws agains this now? does vt have a similar law?

are you guilty of the offense? if so, admit it, not a big deal, and take it as a life lesson. buy a headset if you were handheld and avoid the issue in the future. at least calls aren't illegal while driving yet.

everyone needs/wants their hard-earned money, and the various states/entities are strapped too. you want the police there to help you in an emergency, so if you get busted occaisionally, so be it. you don't have to like it, you are certainly welcome to gripe about it, but accept it, laugh ruefully, and go on. your story might save your friends/family the same expense in the future.

you mention the work over a $100 ticket if they have to supoena your phone records. the same applies for you, if you have to file a deposition, does the time/cost invovled for you make the ticket now cost $200 instead of $100? or whatever it will cost time/money-wise.

not a real lecture, but it's one of the most flagrantly flouted laws here in cali, and it's so easy to avoid/fix. if you're guilty, admit responsibility. if you're not, then fight it as best you can, and best of luck!
