May depend on State law Posted by MI-Roger [Email] (#882) [Profile/Gallery] (more from MI-Roger) on Sat, 24 Dec 2011 06:30:20 In Reply to: Parking lot accident - fault?, steve, Fri, 23 Dec 2011 18:24:16 Members do not see ads below this line. - Help Keep This Site Online - Signup |
I had a similar collision 5 years ago. I was backing my 9-5 out of a parking stall, turning to the left, trying very had not to hit the car parked on my left who only pulled 2/3s of the way into their stall (and I am one of those OCD individuals who insist on backing all the way out into the drive aisle, the correct way) when I hit a car "waiting" in the drive lane.
I am pretty sure this driver either was trying to drive past me while I was backing, or wasn't paying any attention at all and drove into my motion path. Doesn't matter, in Michigan the car backing up has to yield to the cars traveling straight even though the car traveling straight is the only one with an unobstructed field of view and more opportunities to avoid the collision.
I received paint scratches on the corner of my rubber bumper cover that I opted to not have repaired (a couple of black scratches below any reasonable sight line in a dark Grey bumper cover) while the other car, a Pontiac Sunfire(?) had the entire driver's side fender crushed and the driver's side door made inoperable.
The disparity of damage makes me wonder how much of her damage was pre-existing. But the fault was mine by State law and unreportable to any police agency since it occurred on private property.
