For the amount you are talking about it would be small claims court. You can sue for the amount due plus court costs... and in some cases attorney fees.
My suggestion would be figure out how to file, what the recoverable court costs are, and if you could get attorney fees, (and if so, find a lawyer that could represent you... but don't start racking up charges yet). Figure out who in the shop would need to be there (i.e. who would need to be subpoenaed).
Go to the shop and ask them again for a check on the spot. If they refuse tell them your only remidy would then be small claims court:
- If the shop is a partnership you are filing againt all of them.
- With court (& maybe lawyer) costs it will cost them X dollars more.
- There will be lost time not only for one of them to defend, but you will need to subpoena others who will have lost time. And if that person in an employee, the shop will need to pay them for their time as it is work.
