Life always has its twists...better hope this doesn't happen to you...
Traded my 2000 Viggen into a dealer back in July of 2001. I have all the paperwork. Before I traded my car I had it on Saabnet in a classified and had emailed back and forth with the person that ended up buying my Viggen a few week laters from the dealer that bought my car. About a year later I got some odd paperwork regarding my old Viggen being involved in a wreck in NJ and citing me as the driver - this is obvoisuly wrong since I hadn't owned the car for nearly a year and I live 1300 miles away from the scene. The date of the accident was Jan 15th, 2002 - 6 months after I traded it to the dealer. I called the insurance company that was making the claim against me and cleared everything up and hadn't heard about this again....until today.
Today I got a certified letter in the mail that I am being sued by the driver of one of the people in the accident. Reading the document it sounds like a pretty bad accident. It correctly cites the guy that bought the car as the driver, but ME as the owner at the time of the accident which is completely false. I will be calling the attorney filing the suit regarding the matter to clear this up, but I want to make sure I take care of this correctly and close all the loose ends. I need advice as to what I should do to make sure my name is 100% removed from this case and so that I am legally exhonorated forever.
I have no idea why they ever thought I was the owner of the vehicle at the time of the accident in the first place. My hypothesis is that they think I am the owner because at the accident scene they found something in the glove box with my name on it (probably the maintenance records). Lesson learned -- I am NEVER giving up my records again. I only did it because I knew the car would go to another Saab fanatic that would want the records. Forget that! Too bad though.
Please -- anyone with a similar experience or any attorneys out there with some advice??? I really want to close this one tight.
ALSO -- If any one has a free carfax report I can use to show the ownership history I would appreciate it. I have all the records from when I traded the car so I should be OK, but a carfax as a 2nd form of documentation would be helpful -- I just don't want to waste the money on the service given the situtation.
