I should add this is in Illinois and they test through a scan by connection to your OBD port- not the simple exhaust sniffer test.
After it failed even with no CEL they told me to drive it around for a week and come back- thats all I did and it passed. Something is clearly stored on board for a period of time after a CEL/code is cleared.
When we had the simple exhaust sniffer test in IL you could pass that sometime by just changing gas brands. They can be pretty simple tests and obviously they aren't checking the OBD beyond looking at your dash.
