I got a ticket the other day. There are no points for this section (PA 3111A), but I am still concerned. The "Nature of Offense" on the citation is states as "Other: Def. failed to obey posted 55 mph speed zone sign. M/V paced at 90 mph" In the remarks section is states: "Careless ln. change"
Since there are no points, I am tempted to just pay the $104 fine. However, I am concerned that a statement like that will end up on my driving record. If I get pulled over in the future and the cop pulls up my record and sees "paced at 90 mph," he will be much more inclined to issue a ticket.
I have no experience with this, as I usually drive defensively and I never get pulled over. I am afraid to make matters worse by fighting this and having the court change the offense on me. Is this possible? I mean, is it possible for the prosecutor or whoever to change the offense from "Other" to "Speeding", which will result in points on my record? Is the offense and/or fine set in stone by being written on the citation? Can the police officer say "I gave you a break and since you want to fight, I am now pushing for speeding 90 in 55 zone"??!
This is in Penndel, Bucks County, Pennsylvania.
