I don't believe the prosecuting district attorney (or rep thereof) can change it to a worse charge, but they can negotiate a guilty plea for a lesser charge so you don't have to waste time in front of the judge and the attorney gets another conviction towards his conviction record. But, I think you are getting off lucky. Perhaps the officer also felt the conditions were not so greatly dangerous (no traffic, clear weather, good mood, whatever). Most of the 55 highways here in Cali are now 65. I can't say I don't put the 9-3 to 90 on a clear 280 with its 4 huge empty and gently curving lanes sometimes so I'm unable to throw any stones... ;-) Hasn't everyone played with the average speed and MPG displays on the SID or am I the only one. :-) ;-)
