Of course,
I drew up a contract and a durable power of attorney (I was not the registered owner) before the sale and had her sign it on the hood before she made out the check...
Here is a snippet...
"In connection with the described vehicle, seller expressly disclaims all warranties, either express or implied, including, but not limited to, any implied warranty of merchantability or fitness for a particular purpose. Seller acknowledges that to the best of their knowledge said vehicle is in good running condition and is sold “as-is”. Seller neither assumes nor authorizes any other person to assume for seller any liability in connection with the sale of the described vehicle. Seller's disclaimer of warranties contained in this bill of sale does not affect, in any manner, the terms of any warranty from the manufacturer of the described vehicle that may be applicable to the vehicle."
I think that just about covered it.
I am pretty sure she has no legal recourse but I'd rather pay a hundred bucks or two not to have to deal with the hassles and such.
